WHAT IS A NURSING HOME VIOLATION?

Generally speaking, nursing homes and convalescent homes are controlled by Title 22  and the 1987 Nursing Home Reform Act. Title 22 provides the requirements nursing homes in California must meet to get their license. In short, nursing homes must provide the following:

  1. safe and healthful living accommodations
  2. personal assistance and care
  3. observation and supervision
  4. planned activities
  5. food service
  6. arrangements for getting incidental medical and dental care.

The 1987 Home Reform Act sets the standard of care for nursing homes, convalescent homes, and assisted living facilities. Its purpose was to protect those who need help with the daily activities of living from neglect and and abuse. To this end, assisted living facilities are required to provide the following:

  1. Individual care plans for each person
  2. Full-time social worker (facilities with more than 120 beds)
  3. Medical and pharmaceutical services
  4. Nursing services
  5. Rehabilitation services
  6. Social services
  7. Nutritional/dietary services.
